A Texas appellate panel dismissed a medical malpractice suit over a botched spinal surgery, ruling that the plaintiff’s expert report failed to properly explain how the alleged negligence caused the injury. The panel held that the report submitted by the plaintiff’s medical expert did not comply with the Texas Medical Liability Act, specifically regarding causation. The trial court erred by finding the report passed muster under the TMLA. The panel instructed the trial court to grant the defendant’s motion to dismiss and award reasonable attorney fees and costs.
